CraveFest rules and regulations
Failure to comply with the following rules and regulations will disqualify you,
or the party you represent, from CraveFest, the website, the festival, the contest
and any related activities or services.
CraveFest reserves the right to disqualify and or remove or revoke any content,
membership, prize, award, dealings, service or affiliation at any time for any reason,
and without explanation, consent or notice.
CRAVEFEST does not share your personal email, contact and website behavior information
with tele-marketers, information houses, or any external companies. Information about
submitted videos, artists and songs will be made available to press and reporting
agencies, as well as the general public via the website or websites (internal or
external), printed materials and other promotional activities. By submitting such
information you authorize it to be used for these purposes without any claim, rights
or ownership over its use.
Note: only 1 genre or genre group per video is permitted. You are not permitted to
submit the same video/song multiple times to different genres or genre groups. This
includes, re-edits, different cuts of the same music video, minor remix modifications
or content changes. CraveFest reserves the right to reclassify your video genre
at any time and for any reason.
THE CRAVEFEST MUSIC VIDEO AWARDS FESTIVAL (THE “CONTEST”) IS INTENDED TO BE CONDUCTED
IN CANADA ONLY AND SHALL BE CONSTRUED AND EVALUATED IN ACCORDANCE WITH APPLICABLE
CANADIAN LAW. THE CONTEST IS VOID WHERE PROHIBITED BY LAW, OR WHERE THE REGISTRATION
OR FILING REQUIREMENTS OF ANY STATE OR LOCAL JURISDICTION HAVE NOT BEEN COMPILED
WITH. NO PURCHASE IS NECESSARY TO ENTER. VOID IN WHOLE OR IN PART WHERE PROHIBITED
BY LAW. ENTRY IN THE CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE
“CONTEST RULES”).
- 1. ELIGIBILITY. To be eligible for the Contest, an individual must:
- (a) Be resident of an area where the contest is not prohibited by law
- (b) be thirteen (13) years of age or older at the time of entry. Any participant
under the age of majority in his/her province or territory of residence must have
a parent or legal guardian sign on their behalf all documentation required in connection
with the Contest, including but not limited to the Release (as defined below), the
Video License Agreement (as defined below), and the Submission Form (as described
below)
- (c) be legally able to travel to the United States of America in the event that
the entrant is selected as an Original Video Winner (as defined below);
- (d) be the exclusive owner of, or a licensee with the right to sub-license, all
right, title and interest (including copyright) in and to the Video (as defined
below);
- (e) consent to the use and re-use of the Video, or any portion thereof, in accordance
with the Video License Agreement (as defined below);
- (f) not be party to any agreement granting rights or interests in and to the Video
to a third party that would restrict the Sponsors’ use of the Video in accordance
with the Video License Agreement;
- (g) in order to be eligible for the “Unsigned” category an individual must not have
commercially released any sound recording, licensed any sound recording or musical
work for commercial release or published any musical work; (updated)
- (h) in order to be eligible for the “Unsigned” category an individual must not currently,
or as of the end of the Contest Period (as defined below), be party to a record,
music publishing, and/or other similar agreement with any third party, including
but not limited to any recording, distribution and/or music publishing company;
(updated) Employees of Canadian Rock and Video Entertainment Festival (“CraveFest”),
HMV Group PLC, Entertainment One Limited Partnership dba HMV, Maxell, Gem-Sen, Kicker,
and JL Audio (collective, the “Sponsors”), (UPDATED) its and their respective affiliates,
subsidiaries, related companies, advertising and promotional agencies, Judges (as
defined below), and the household members and/or the immediate family of any of
the above are not eligible to participate in the Contest. For the purpose of the
Contest Rules, “immediate family" means husband, wife, spouse, partner, mother,
father, brother, sister, son and/or daughter, whether or not they reside in the
same household.
The Sponsors shall have the right at any time to require proof of identity and/or
eligibility to participate in the Contest. Failure to provide such proof may result
in disqualification. All personal and other information requested by and supplied
to the Sponsors for the purpose of this Contest must be truthful, complete, accurate
and in no way misleading. The Sponsors reserve the right, in their sole discretion,
to disqualify any entrant should such entrant at any stage supply untruthful, incomplete,
inaccurate or misleading personal details and/or information.
- 2. CONTEST PERIOD. The Contest opens at 12:00 a.m. Eastern Daylight Time
(“EDT”) on April 1, 2008 and closes at 11:59 p.m. EDT on July 18, 2008 (the “Contest
Period”).
- 3. HOW TO ENTER. No purchase is necessary to enter the Contest. To enter:
- (a) Prepare a music video (each, a “Video” and collectively, the “Videos”) in any
or all of the following categories: (1) Punk/Rock/Metal; (2) Rap/Hip Hop/R&B; and (3)
Electronic/Dance/World (each, a “Category” and collectively, the “Categories”);
Categories may be updated and or changed at any time.
- (b) Complete and submit a video submission form available online at the Contest
Website (“Submission Form”), including the following information: name, mailing
address, e-mail address, telephone number, title of the Video; and band information.
- (c) Submit the Video and the Submission Form online at www.cravefest.com (the “Website”)
or by mail to the attention of CraveFest Video Submission c/o 266 Applewood Crescent,
Concord, Ontario L4K 4B4 Canada. (Please note: processing fees apply when sending video
submissions by mail. Submission of a Video and Submission Form in accordance
with the Contest Rules constitutes an “entry” in the Contest. No entries will be
accepted by any other means. Each single (1) video may only be submitted to a single
(1) Category or Category group. All entries (including Videos) become the sole
property of the Sponsors and none will be returned for any
reason. In the event that an entrant is selected to participate in the CraveFest
Music Video Festival (described below), he/she must provide to the Sponsors a high
quality uncompressed file (.MOV, .AVI) or professional tape format (BetaSX/SP, DV, DigiBeta etc.)
version of the Video upon request. The Sponsors reserve the right, in their sole discretion,
to refuse a Video and/or Submission Form for any reason whatsoever. All entries
must be received no later than the end of the Contest Period (July 18, 2008
at 11:59 p.m. EDT). No correspondence or communication will be entered into except
with selected entrants. Entries will be declared invalid and automatically disqualified
if they are late, illegible, incomplete, damaged, irregular, mutilated, forged,
garbled, or determined to be inappropriate or offensive in the sole discretion of
the Judges or the Sponsors. Entries received online shall be deemed to be submitted
by the authorized account holder of the e-mail address associated with the entry.
For the purpose of the Contest Rules, “authorized account holder" of an e-mail address
is defined as the natural person who is assigned to an e-mail address by an Internet
access provider, on-line service provider, or other organization responsible for
assigning e-mail addresses for the domain associated with the submitted e-mail address.
A potential winner may be required to provide the Sponsors with proof that the potential
winner is the authorized account holder of the e-mail address associated with the
winning entry.
- 4. VIDEO. In order to be eligible, a Video must meet the following requirements:
- (a) The Video must be no longer than eight (8) minutes in length;
- (b) The Video must be submitted online at www.cravefest.com in a common digital video format.
- (c) The file size of a Video submitted online must be within reasonable file size limits.
There is no size restriction for Videos submitted by mail. (duration limitation still applies)
- (d) The video must NOT have EVER been entered into a previous CraveFest awards festival.
- (e) The video must be produced or released on or after Jan 1st 2007.
By submitting a Video, entrant represents and warrants that: (i) the Video, and
all right, title, and interest (including copyright) therein and thereto, is exclusively
owned and/or controlled by the entrant to the full extent necessary to enable the
Sponsors to use the Video as contemplated by the Contest Rules and the Video License
Agreement; (ii) he/she has obtained (or will obtain) all necessary licenses, approvals,
consents, and permissions in connection with any and all material incorporated into
the Video; (iii) the Video does not contain any material that is libelous, defamatory,
profane, or obscene, as determined by the Sponsors in their sole discretion; and
(iv) neither the Video, nor any part thereof, infringes upon the intellectual property
or other statutory or common law rights of any third party.
- 5. CONTEST PRIZES.
Final award categories and prizes will be announced before August 2008.
- 6. FINALIST AND WINNER SELECTION.
- (a) Voting Period: During the Contest Period, Videos will be posted to the Contest
Website where the public will have an opportunity to vote for their favourite Video.
Votes will be accepted by the Sponsors between June 26th, 2008 at 12:00 p.m. EDT
and August 1st, 2008 at 11:59 p.m. EDT (inclusive) (the “Voting Period”).
- (b) Finalist Selection and Notification: On August 5th, 2008, the Sponsors will post
to the Contest Website the names of the five (5) top rated Videos in each Category
as voted by the public during the Voting Period. Each entrant who has submitted
a top rated Video will be declared a “Finalist”, and will have the opportunity to
participate in the CraveFest Music Video Festival, which shall take place in Toronto,
Ontario, on August 17 of 2008. (the “CraveFest Music Video Festival”). Finalists will
be notified by telephone/email prior to the CraveFest Music Video Festival. Each
Finalist will be solely responsible for transportation to and from Toronto, Ontario,
and accommodations during the CraveFest Music Video Festival.
- (c) Winner Selection and Notification: During the CraveFest Music Video Festival,
the Finalists’ Videos will be viewed by an official judging panel to be selected
by the Sponsors in their sole discretion (the “Judges”). In August of 2008, at
a time and location to be determined by the Sponsors, the Judges shall select and
announce the potential Winners based on the following judging criteria: (1) Best
Song: melody, harmony, lyrics, and appropriate delivery; and (2) Best Video: overall
quality of visual and audio components, plot, artistic quality, and appropriate
delivery of genre. The final determination of the Winners and the application of
the judging criteria shall be in the sole and absolute discretion of the Judges.
The odds of winning depend upon the Judges’ subjective application of the judging
criteria. Winners will be announced and notified during the CraveFest Music Video
Festival Awards night in August of 2008 in Toronto, Ontario. Winners who are not
present at the Awards Night will be notified via telephone/email within two working
days after the Awards Night.
- 7. RELEASE AND INDEMNITY. Each Winner shall be required to execute a declaration
of eligibility, and publicity and liability release (the “Release”), confirming
that the Winner: (i) accepts the Prize as offered; (ii) is eligible for the Contest,
(iii) has complied, and will continue to comply, with the Contest Rules; (iv) releases,
indemnifies, and holds harmless the Sponsors, their parent companies, subsidiaries,
affiliates, and its and their employees, directors, officers, suppliers, agents,
sponsors and administrators (collectively, the “Releasers”) from any and all liability
for any loss, harm, damages, cost or expense arising out of his/her participation
in the Contest, participation in any Contest-related activity, or the acceptance,
use, or misuse of his/her Prize, including but not limited to costs, injuries, losses
related to personal injuries, death, damage to, loss or destruction of property,
rights of publicity or privacy, defamation, or portrayal in a false light, or from
any and all claims of third parties arising therefrom; (v) grants to the Sponsors
the right to use and re-use the Video in accordance with the Video License Agreement;
and (vi) grants to the Sponsors and its licensees, successors, assigns, affiliates
and partners, the unrestricted right (but not the obligation) to use and re-use
(without compensation) the Winner’s voice, likeness, name, appearance and biographical
material in any and all media now known or hereafter devised, in connection with
the Contest and the promotion and exploitation thereof. The executed Release must
be returned to the Sponsors within five (5) business days of receipt or the selected
potential Winner will be disqualified and the Prize forfeited.
- 8. LIMITATION OF LIABILITY. The Sponsors assume no responsibility or liability
for lost, late, misdirected or incomplete entries, notifications, responses, replies
or any Release, or for any computer, online, software, telephone, hardware or technical
malfunctions that may occur, including but not limited to malfunctions that may
affect the transmission or non-transmission of an entry. The Sponsors are not responsible
for any incorrect or inaccurate information, whether caused by website users or
by any of the equipment or programming associated with or utilized in the Contest
or by any technical or human error which may occur in the administration of the
Contest. The Sponsors assume no responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications line failure,
theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors
are not responsible for any problems, failures or technical malfunction of any telephone
network or lines, computer online systems, servers, providers, computer equipment,
software, e-mail, players, or browsers, on account of technical problems or traffic
congestion on the Internet, at any website, or on account of any combination of
the foregoing. The Sponsors are not responsible for any injury or damage to entrant
or to any computer related to or resulting from participating in or uploading/downloading
materials in connection with this Contest. Entrant assumes liability for injuries
caused or claimed to be caused by participating in the Contest, or by the acceptance,
possession, use of, or failure to receive any Prize. The Sponsors assume no responsibility
or liability in the event that the Contest cannot be conducted as planned for any
reason, including those reasons beyond the control of the Sponsors, such as infection
by computer virus, bugs, tampering, unauthorized intervention, fraud, technical
failures, or corruption of the administration, security, fairness, integrity or
proper conduct of this Contest, the Contest Website and/or any related website.
- 9. CONDUCT. By entering this Contest, entrant agrees to be bound by the Contest
Rules, which will be posted at the Contest Website throughout the Contest Period.
Entrant further agrees to be bound by the decisions of the Judges and the Sponsors,
which shall be final and binding in all respects.
The Sponsors reserve the right, in their sole discretion, to disqualify any entrant found to be:
- (a) violating the Contest Rules, regulations, and or terms of use;
- (b) tampering or attempting to tamper with the entry process or the operation of
the Contest, the Contest Website, or any related website; and/or process.
- (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy,
abuse, threaten or harass any other person.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE
OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL
AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO
SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT
NOT LIMITED TO CRIMINAL PROSECUTION.
- 10. PRIVACY / USE OF PERSONAL INFORMATION. By participating in the Contest,
entrant: (a) grants to the Sponsors the right to use his/her name, age, mailing
address, telephone number, and e-mail address (“Personal Information”) for the purpose
of administering the Contest, including but not limited to contacting and announcing
the Finalists, and Winners; (b) grants to the Sponsors the right to use his/her
Personal Information for publicity and promotional purposes relating to the Contest,
in any and all media now known or hereafter devised, without further compensation,
unless prohibited by law; and (c) acknowledges that the Sponsors may disclose his/her
Personal Information to third-party agents and service providers of any of the Sponsors
in connection with any of the activities listed in (a) and (b) above. The Sponsors
will use the entrant’s Personal Information only for identified purposes, and protect
the entrant’s Personal Information in a manner that is consistent with the CraveFest
Privacy Policy available at: PRIVACY POLICY
- 11. INTELLECTUAL PROPERTY. All intellectual property, including but not limited
to trade-marks, trade names, logos, designs, promotional materials, web pages, source
code, drawings, illustrations, slogans and representations are owned by the Sponsors
and/or its and their affiliates. All rights are reserved. Unauthorized copying or
use of any copyrighted material or intellectual property without the express written
consent of its owner is strictly prohibited.
- 12. LAW. These are official Contest Rules. This Contest is subject to applicable
federal, provincial and municipal laws and regulations. These Contest Rules are
subject to change without notice in order to comply with any applicable federal,
provincial and municipal laws or the policy of any other entity having jurisdiction
over the Sponsors. All issues and questions concerning the construction, validity,
interpretation and enforceability of the Contest Rules or the rights and obligations
as between the entrant and the Sponsors in connection with the Contest shall be
governed by and construed in accordance with the laws of the province of Ontario
and the laws of Canada applicable therein including procedural provisions without
giving effect to any choice of law or conflict of law rules or provisions that would
cause the application of any other jurisdiction’s laws.
- 13. LANGUAGE DISCREPANCY. In the event of any discrepancy or inconsistency
between the terms and conditions of the Contest Rules and disclosures or other statements
contained in any Contest-related materials, including but not limited to the Contest
entry form, or point of sale, television, print or online advertising, the terms
and conditions of the Contest Rules shall prevail, govern and control.
- 14. TERMINATION. CraveFest reserves the right, in its sole discretion, to
terminate the Contest, in whole or in part, and/or modify, amend or suspend the
Contest, and/or the Contest Rules in any way, at any time, for any reason without
prior notice.
- 15. VIDEO LICENSE AGREEMENT. By entering the Contest, the entrant acknowledges
and agrees that he/she shall be bound by the terms and conditions of the Video License
Agreement, attached hereto as Schedule A (the “Video License Agreement”). Entrants
who do not consent to the Video License Agreement will be disqualified.
